Terms of Service

These Terms of Service (“Terms”) govern your use of Mailex. By creating an account or using the service you agree to these Terms. If you do not agree, do not use Mailex.

1. The service

Mailex orchestrates email campaigns across SMTP servers, domains and sender inboxes that you own or are authorized to use. Mailex does not provide sending infrastructure: your mail is delivered through your own servers, and your sender reputation remains yours.

2. Your account

You must provide a valid email address and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old and legally able to enter into this agreement.

3. Acceptable use

You agree NOT to use Mailex to:

  • Send unsolicited bulk email (spam) or email lists purchased, rented or harvested without the recipients' consent.
  • Violate applicable laws, including anti-spam and data-protection laws such as CAN-SPAM, GDPR and ePrivacy.
  • Send phishing, malware, or deceptive content, or forge headers and sender identities you are not authorized to use.
  • Send illegal content or content that infringes the rights of others.
  • Interfere with or attempt to circumvent the platform's limits and security measures.

Every commercial email you send must identify you truthfully and include a working way for recipients to opt out. We may suspend or terminate accounts that violate this section, with or without notice, and may pause campaigns that show signs of abuse.

4. Your content and data

You retain all rights to your message content and recipient lists. You grant us the limited right to process them solely to operate the service. You are the data controller for your recipients; see the Privacy Policy for details.

5. Billing

  • Mailex is prepaid: you top up an internal USD balance with cryptocurrency via NOWPayments.
  • Subscription plans are billed from your balance per 30-day period. If your balance can't cover a renewal, the subscription expires — nothing else is charged.
  • Crypto top-ups are final and non-refundable, except where a refund is required by law.
  • Prices may change; changes never apply retroactively to a period you have already paid for.

6. Intellectual property

Mailex, its software, design and branding are our property. These Terms grant you a limited, non-exclusive, non-transferable right to use the service; they do not grant you any rights to our code or trademarks.

7. Disclaimers

The service is provided “as is”. Email delivery depends on your servers, DNS configuration, recipient providers and factors outside our control — we do not guarantee that any message will be delivered, land in the inbox, or achieve any particular open rate.

8. Limitation of liability

To the maximum extent permitted by law, Mailex is not liable for indirect, incidental or consequential damages, or for loss of profits, data or reputation. Our total liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.

9. Termination

You may stop using Mailex and delete your account at any time. We may suspend or terminate your access for violation of these Terms. Sections that by their nature should survive termination (including 4, 6, 7 and 8) survive it.

10. Changes to these Terms

We may update these Terms as the product evolves. For material changes we will notify you by email or through the app; continued use of the service after the changes take effect constitutes acceptance.
